Terms for app subscriptions, digital services and website offers.
These Terms govern all contracts between Gearstack, obrt za računalno programiranje i usluge, vl. Kristijan Bezjak ("Gearstack"), and consumers purchasing the Gearstack Health app and related services.
A consumer is any natural person entering into the transaction primarily for private purposes.
Gearstack provides a health app for iOS that analyses vital signs derived from Apple Watch measurements. Gearstack Health is a wellness product, not a medical device. The analyses provided do not replace medical diagnosis or treatment.
The integrated health coach uses generative artificial intelligence (AI). Answers are generated automatically, may occasionally be incomplete or incorrect, and do not constitute medical advice. AI-generated content is labeled as such in the app.
The subscription contract is formed once the purchase is successfully completed via the Apple App Store.
All prices include applicable VAT.
Billing is handled through the Apple App Store. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. Cancellation is managed in your Apple ID settings.
The app becomes available via the Apple App Store in late July 2026.
Requirements: iPhone with iOS 16 or newer, Apple Watch (Series 6+ recommended).
Consumers have a 14-day right of withdrawal. Details in the Withdrawal Instructions.
Important: The right of withdrawal expires for digital content once performance has begun with the customer's express consent (Art. 18 Austrian Distance Selling Act).
Statutory warranty rights apply. In case of defects, the customer may demand subsequent performance. If this fails, the remaining statutory remedies apply (price reduction, rescission).
Gearstack is liable without limitation for intent and gross negligence as well as for injury to life, body or health.
Liability for slightly negligent breaches is limited to foreseeable, contract-typical damages.
Gearstack Health does not replace medical advice. Gearstack accepts no liability for decisions made based on app recommendations.
Processing of personal data follows our Privacy Policy.
Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers habitually residing in another EU member state, mandatory consumer protection rules of that state remain unaffected.
Should individual provisions be invalid, the validity of the remaining provisions is unaffected.
