Device Terms

These device terms apply to the purchase, hire purchase and rental of the measuring devices offered on g-stack.app by Gearstack, obrt za računalno programiranje i usluge, vl. Kristijan Bezjak, Ježdovečka ulica 2A/1, 10250 Lučko, Zagreb, Croatia ("Gearstack").

They apply to consumers and to businesses. A consumer is any natural person entering into the contract predominantly for private purposes. They supplement the Terms of Service; where the two differ, these device terms prevail for devices.

Joining the waiting list is a non-binding reservation with nothing to pay. Once a delivery date is known, we send an email stating the device, the variant (purchase, hire purchase or rental), the price, shipping costs and the delivery date. The contract is formed when the customer accepts this offer by email.

We confirm the order in writing by email. The confirmation contains everything that applies to the chosen variant, including the cash price, the total price and the instalment schedule for hire purchase.

Prices for consumers are in euros and include Croatian VAT (PDV) at 25 %. Prices for organisations are net prices plus VAT, as shown on the pricing page.

We issue invoices by email. Payment is by bank transfer or by the payment method named in the confirmation. Monthly instalments and rental fees are due at the beginning of each month. Statutory default interest applies to late payments.

We deliver within Croatia. We offer delivery to other EU countries once the registration for electrical equipment and packaging required there is in place; we state this in the confirmation. Shipping costs and the delivery date are given in the confirmation. For consumers, risk passes on handover of the device.

With a purchase the customer pays the purchase price once. Ownership of the device passes to the customer on full payment. The Health Pro subscription is not part of a purchase and runs separately under the Terms of Service.

With hire purchase the customer pays the price in twelve or six equal monthly instalments. The confirmation states the cash price of the device, the total of all instalments, and the amount and due date of each instalment. No interest and no fees are charged. Health Pro is included in the instalment for the duration; after the last instalment Health Pro continues as a regular subscription unless the customer cancels it.

The device remains the property of Gearstack until the last instalment is paid (retention of title). Until then the customer may not sell, pledge or permanently hand it over to third parties. The customer may pay the outstanding balance in full at any time without surcharge.

If the customer falls behind with two consecutive instalments and does not pay within a written grace period of 14 days, we may withdraw from the contract and demand the device back, or declare the entire outstanding balance due. On return we refund the instalments paid, less reasonable compensation for use and for any reduction in the value of the device.

Rental starts on delivery and has a minimum term of twelve months. It then continues for an indefinite period and either side may cancel it with one month's notice to the end of a month. Rent is due monthly in advance and includes Health Pro for the duration of the rental.

The device remains the property of Gearstack. The customer treats it with care; normal signs of use are fine. We provide each renter with a new textile strap for the chest strap and a new wristband for the activity band; these stay with the customer after the rental. If the device fails through no fault of the customer, we replace it within ten working days. In case of loss, theft or damage for which the customer is responsible, the customer pays the current value, capped at the list purchase price.

After the rental ends the customer returns the device to Gearstack within 14 days; within Croatia we provide a free return label. If the device is not returned despite a reminder, we charge its current value.

After the minimum term the customer may take over the device at its residual value: chest strap €29, activity band €59, both together €79. Ownership passes on payment of the residual value and the rental ends.

Consumers may withdraw from the contract within 14 days without giving reasons. For purchase and hire purchase the period starts on receipt of the device, for rental on formation of the contract. Details, the model form and the consequences are set out in the Withdrawal Policy.

Customers who want to use Health Pro immediately consent to the service starting before the period ends and, on withdrawal, pay the share for the service already provided. The consumer bears the cost of returning the device and is liable for any loss in value resulting from handling beyond what is needed to check its nature and functioning.

Consumers have the statutory liability for defects of two years from delivery under Croatian law. A manufacturer's guarantee applies in addition; we handle the process. For businesses the warranty period is one year. For rentals, Gearstack keeps the device in working order for the entire term.

Excluded are damage from improper use, moisture beyond the manufacturer's specifications, tampering with the device, and normal wear of the textile strap, wristband and battery.

The devices transmit measurements to the Gearstack Health app via Bluetooth. The app is governed by the Terms of Service and the Privacy Policy. Health Pro from hire purchase and rental is activated through the customer's account in the app.

Gearstack Health is a wellness product and not a medical device. Measurements and analyses do not replace a medical examination, diagnosis or treatment.

Gearstack is liable without limitation for intent and gross negligence and for injury to life, body and health. Otherwise liability is limited to foreseeable damage typical for this kind of contract. Mandatory consumer rights remain unaffected.

The law of the Republic of Croatia applies. For consumers resident in another EU country, the mandatory consumer protection rules of their country of residence continue to apply. For businesses, the courts of Zagreb have jurisdiction.

Consumers may turn to the bodies designated in Croatia for out-of-court dispute resolution, such as the Mediation Centre of the Croatian Chamber of Economy (Centar za mirenje pri Hrvatskoj gospodarskoj komori). Version: September 2026.
