Device Terms

These device terms apply to the purchase, hire purchase and rental of the measuring devices offered on g-stack.app by Gearstack, obrt za računalno programiranje i usluge, vl. Kristijan Bezjak, Ježdovečka ulica 2A/1, 10250 Lučko, Zagreb, Croatia ("Gearstack").

They apply to consumers and to businesses. A consumer is any natural person entering into the contract predominantly for private purposes. They supplement the Terms of Service; where the two differ, these device terms prevail for devices.

A shop enquiry is non-binding and creates no order or payment. Your personal quote confirms the device, payment option, availability, price, shipping costs and delivery date. A contract is formed only when the complete offer is accepted.

Planned shop prices do not confirm a stock allocation. Existing contracts retain their agreed terms.

Prices for consumers are in euros and include Croatian VAT (PDV) at 25 %. Prices for organisations are net prices plus VAT, as shown on the pricing page.

We issue invoices by email. Payment is by bank transfer or by the payment method named in the confirmation. Monthly instalments and rental fees are due at the beginning of each month. Statutory default interest applies to late payments.

We currently deliver devices exclusively within Croatia. Shipping costs and the delivery date are stated in your personal quote and confirmed before ordering. Delivery to Germany is not yet available. For consumers, risk transfers upon delivery of the device.

With a purchase the customer pays the purchase price once. Ownership of the device passes to the customer on full payment. The Health Pro subscription is not part of a purchase and runs separately under the Terms of Service.

The hire purchase model displayed in the shop is being prepared. The plan is twelve monthly instalments for the device and twelve months of Gearstack Health Pro. Ownership is intended to transfer after full payment. The device portion exceeds the direct purchase price; planned totals, the app portion and device premium are shown in the shop.

Before entering a contract, customers receive full terms including cash price, total amount, premium, payment dates, ownership transfer, withdrawal and early repayment. Where legally required, the offer also includes the prescribed credit information. The model will be offered only once availability and contract terms are confirmed. It is not advertised as interest-free or free of charges.

Health Pro access beyond twelve months is arranged separately. Existing instalment contracts retain their agreed terms.

The current shop launch focuses on direct purchase and planned twelve-month hire purchase. Device-only rental is not part of this new consumer offer.

Existing rental contracts and separate organisation offers retain their individually agreed duration, return and purchase terms.

Consumers may withdraw from the contract within 14 days without giving reasons. For purchase and hire purchase the period starts on receipt of the device, for rental on formation of the contract. Details, the model form and the consequences are set out in the Withdrawal Policy.

Customers who want to use Health Pro immediately consent to the service starting before the period ends and, on withdrawal, pay the share for the service already provided. The consumer bears the cost of returning the device and is liable for any loss in value resulting from handling beyond what is needed to check its nature and functioning.

Consumers have the statutory liability for defects of two years from delivery under Croatian law. A manufacturer's guarantee applies in addition; we handle the process. For businesses the warranty period is one year. For rentals, Gearstack keeps the device in working order for the entire term.

Excluded are damage from improper use, moisture beyond the manufacturer's specifications, tampering with the device, and normal wear of the textile strap, wristband and battery.

Data available in Gearstack Health depends on the device, app version, transfer method and permissions. The supported scope and Health Pro provisioning in the planned hire purchase are confirmed before a contract is formed. The app is subject to the Terms and Privacy Policy.

Polar devices can also be used without a Gearstack subscription. Gearstack Health is a wellness product, not a medical device. Measurements and analysis do not replace medical examination, diagnosis or treatment.

Gearstack is liable without limitation for intent and gross negligence and for injury to life, body and health. Otherwise liability is limited to foreseeable damage typical for this kind of contract. Mandatory consumer rights remain unaffected.

The law of the Republic of Croatia applies. For consumers resident in another EU country, the mandatory consumer protection rules of their country of residence continue to apply. For businesses, the courts of Zagreb have jurisdiction.

Consumers may turn to the bodies designated in Croatia for out-of-court dispute resolution, such as the Mediation Centre of the Croatian Chamber of Economy (Centar za mirenje pri Hrvatskoj gospodarskoj komori). Version: September 2026.
